(PR-LEAP / TEXAS) May 13, 2005 – Press Release
TMA INTERNATIONAL TRUSTS TARGETS METHODIST HOSPITALS IN TEXAS FOR MASSIVE MEDICAID FRAUD LITIGATION
Methodist Hospital System Houston, Texas Health Resources,
Methodist Healthcare San Antonio & Methodist Health System Dallas.
TMA International Trusts (TMA) has uncovered undeniable evidence that demonstrates the Methodist Hospitals in Texas and Presbyterian Hospitals owned by Texas Health Resources have been participating in a massive Medicaid Fraud scheme that originates inside the state of Texas Department of Health & Human Services (DHHS) and Department of State Health Services. TMA is working with the Texas DHHS Inspector General’s Office regarding the illegal conduct of state employees.
Texas has been illegally obtaining federal funding under the federal Medicaid program for 30 years through a systematic fraudulent scheme that includes fraudulent quarterly budget reports filed with the federal government and fraudulent annual audits required by federal law that certify state program compliance. The Hospitals under Methodist Hospital System Houston, Texas Health Resources [Methodist and Presbyterian], Methodist Healthcare San Antonio and Methodist Health System Dallas (hereinafter referred to as Hospitals) have been administering the intake portion of the state Medicaid plan for their patients in violation of federal laws [civil & criminal] resulting in false claims being filed with the federal government, via the state, that led to illegal federal funding under Medicaid. Texas and its Medicaid state plan administrators [additional hospitals and contractors to named at a later date] are facing joint & several, statutory liability that exceeds $300 Billion, plus penalties and fines, and private class action lawsuits to be filed on behalf of Patients / Medicaid applicants. The Hospitals will be faced with bankruptcy due to the massive liability, which they have no immunity. Because the liability goes back 30 years it appears the United Methodist Church Conference in Texas could have some liability based on the relationship with the hospitals years ago.
TMA has established itself as “Private Attorney General” or “Relator” under the Federal False Claims Act (FCA) by being the original source of information having done the state wide investigation and putting the federal government on notice, who had no knowledge of the massive fraud. TMA states the Texas state Medicaid plan has been used as a criminal enterprise to illegally obtain federal funding in violation of federal RICO statutes, and TMA intends to use civil RICO as one of its recovery causes of action in addition to the FCA, and other federal recovery statutes.
